Working legally in the US with a Canadian passport (No TN, No H1B)




CD's :
It has been over 5 years and 4 month since I left Canada for India.

I am considering returning to Vancouver, Canada in the near future (say after 2 years).

I am an Architectural Draftsperson by profession and is there a possibility of working in the US legally with a Canadian passport sans TN Visa or a H1B Visa?

Is it possible to move to the USA (as a visitor) and then work at a factory there (labor job) and then some how regularize there, as it is being done by tons of refugees and Mexicans there ?

Please let me know if there are any such possibilities ?

No legally without TN or H1B is almost impossible. Some small company with whom you have connections and contacts might fake your status & allow you to work legally, but most won't take that risk.
There are 12 million illegal immigrants in US. Its a myth they can become legal easily. There is a very very long shot and only a fraction will under rare circumstances. There is a reason they are still illegal.

I do not think there would be that many Canadians working without a visa in US working below minimum wage which cash jobs often are. If they wanted to do so minimum wage or cash jobs, they can do it in Canada itself plus they have universal healthcare here.

I am not really sure what you are up to but may be try a lawyer.

TK what exactly happened? I thought you were doing very good in India! Was that all fluff? Working under the table in the US is about the worst thing you could do.

To be a legal immigrant , you need to be on a Visa or a status.

Other options besides H1 or TN for Canadians to work authorized are

Business (E2 / EB5)

Inter company transfer L1 ( a or b)

TN is a special option for Canadians and should be utilized in case one does not want to go on H1.

Nothing to worry. Every 5 years, I do a 360 degree self appraisal on where I am and what to plan for the future.
Lately I am close to my BE classmates who are all in the US and who were praising the Social Security System and low cost of living. Our CPP max. payout is only $ 1092 per month whereas US Social Security is much higher.

After your replies, I have summerized as follows :

1. Choice 1 - Gulf - But due to the Oil crisis, No jobs. May be it will take minimum 2 years to recover .

2. Choice 2 - India - Economy is stagnant. Highly paying jobs less. Low cost of living. I am comfortable in my job but I feel bored. Keep the jobs as much as possible. Housing buying unaffordable in metros.

3. Choice 3- Canada - Economy is stagnant. Housing cost unreachable. Min wage jobs possible. Partly free healthcare. Welfare and food banks allowed. Savings will be nil but hand to mouth possible.

4. Choice 4 - USA - Almost ruled out. If one can get a TN job possible to work. healthcare costs will punish you.

Forget about health care situation in the US: now you are obligated to buy it if you are employed and it is growing forbiddingly expensive. I am not sure they even have that many jobs there anymore; I know they are having tough time in finding jobs in hot areas of tech like Nanomaterials or pharmatech (these were my areas). When I first arrived in Canada during early 2000s, I used to get calls from US corps asking me to return for work! Many of those small corps I worked for have gone under since.

You need at least 3 crores in Indian banks in deposit accounts to bring in a couple of lacs a month! So think about how to get that dough in dollars. You should have tried back when you were here. Last summer I was in India (coastal Andhra) and very much enjoyed tasty breakfasts for 50-60 cents, great dinner for for a toonie! I am going there next summer to start work on orchard. I think you should find things to do and not make serious moves across the world just because of boredom. As far as Indians in the US goes, most Indians are consummate liars and slaves. They never get tired of telling tall tales even as they huddle in large numbers like rats into dark basements and crouch when they run into unruly blacks or irate whites.

Thanks Global Indian for the response..
The people that I am talking did Engineering and they are my batch mates.
Most of them earn like 150K per year and they have been working in USA since 1996 and they own multiple properties in the US and are Citizens.

Your answer about India is spot on. Many business oppertunities, rent very low, food price too too low etc...

There are some other problems which I am not comfortable in making public in which I am looking to move from India. But till the grass is greener on the other side, I will not be making such move. For the other side to be greener may take a year or may take a decade. I simply donot know.

Everyone's situation is unique. There is no one solution for all.
