Agree that law will decide.
But what if the law is impotent. Don't we have the right to kill the basturd. There must be capital punishment & zero tolerance, only then you will find a reduction in crime no matter which country you refer to.

Should police be allowed to go over the law and kill off criminals? Do you think they will stop with criminals and not misuse this power?

For one thing, India is a democracy and has to follow the processes within a democratic system. India is not a dictatorship or monarchy that they can kill off anybody they like, whatever be the justification.

Every crime and criminal has to be dealt as per law. If the system is poor, steps should be taken to improve it. Going overboard and engaging in encounter deaths for criminals is not the solution. If not, where will you draw the line and stop?

For that matter the presence of IPC too does not show any proof for reduction in crime. Does it mean we have to abolish IPC for all criminals to have a free run.

Once in a while, we hear incidents about doctors and hospitals fleecing patients and filling up hospital beds, even when the patients have no major illnesses. But nothing ever discussed about lawyers, judges, courts and their administrators indulging in malpractices. When there was so much hue and cry about the safety of the women being at stake, the SC has done great disservice to the people of the country in not taking up the Nirbhaya case on priority and not handing out its verdict. The only reason for the same is that the parents of Nirbhaya are very ordinary people unlike corrupt politicians or tax evading MNCs.

103 countries including Canada have abolished capital punishment so far. If capital punishment is the magic bullet to prevent crimes, why would 103 countries give up that magic bullet?

In a democracy, you cannot have instant execution of criminals. It will have to be dealt by courts only. You will have to give the right to fair trial to everyone. Cases will go from lower court to higher court, it will take time, etc. In a dictatorship, there is no need to give the right to fair trial and anyone can be executed at any time.

103 countries have abolished capital punishment because the planet is not going in the right direction. We cannot prepare hygienic food at home if we want cockroaches and insects to co-exist in our kitchen.

For a vast and a highly populated country like India, where it is difficult to police nook and corner. Those who want to abolish capital punishment frequently say, that confinement for life is a worse punishment. Then why go in for the worse, when we can be more 'benign'.

In a democracy like India, even the assassins of a former Prime Minister are given royal treatment. More time they spend in prison, more they are depicted as heroes by fringe groups. In the name of "free and fair trial", the cases are dragged any number of years by vested interests and then that delay itself is stated as reason for their pardon and release. Like killing both parents and then asking for pardon because the murderer is orphan.

Should the right to life be given for those who intentionally take the lives of others? if this is not rarest of rare crime, what else is? It will be better these criminals are made brain dead, their organs harvested and given to needy patients.

If this doesn't hit the nail on its very head then what will?

Without getting into the analogy of cockroaches, I only see people debating and wanting death sentence as if it is going to solve everything. It is only retribution, revenge and people getting satisfaction from revenge to see the criminals dead though it in itself does not address the problem itself. It is basically eye for an eye type of treatment but what does it solve?

The problem in India itself is multifaceted with roots in lack of education, gender inequality, caste system, underreporting due to social stigma, corruption at multiple levels, no fear of getting caught, combined with overloaded and slow justice system.

I only see people focus on death penalty though.

I think a quick Death penalty is not a perfect solution..as rapist never realize what he did ...
those people who find guilty of rape should be treated in same way in prison by fellow Gay Prisoners at least for sometime till rapist understand what he did.

...Govt need to do something to stop this
