Hi

While applying for oci is it necessary to provide spouse original passport and landing paper or photocopy is fine. (earlier nationality of applicant is Indian)and what is the procedure if spouse is back in India and original passport cant be provided.

This is what is mentioned on bls website:
Marital Status:
If married, provide your spouse’s documents as under, even if he/she is not applying for OCI:
- Passport containing Landing Stamp.
- Record of Landing issued by Canadian Immigration authorities.
- If the spouse’s name does not appear in the Indian Passport of the applicant, provide a Marriage Certificate from a competent
authority.
In case of death of spouse:
- Death Certificate issued by government authorities.

Currently, the Indian Government and the BLS are both sticklers for their requirements and about the ORIGINALS of all of the Documents. Things could change anytime and hope it is for the better.

It is true that they are asking for the Spouse's Passport and the Landing papers or the Marriage Certificate in lieu of if it is not available.

SO, Follow it to a tee if you have the documents. If your spouse is in India, is she carrying them on her person? If not, then, locate and submit them. I was told some of the Documents should be provided with a copy and they will verify the same and return the originals back to you. I do not know if it is on the spot return or later through the Mail system. In any case, GET MULTIPLE PHOTOCOPIES to keep, in case they are lost or get misplaced. They all are a miserable bunch when they are handling somebody else's Documents. Play it safely. Also provide them with a Courier way bill as printed by the courier and guaranteed to get them all back to you safely. In your submission to them, attach a list with a "document list" and keep a copy for your files. When all of the Documents get back to you, acknowledge the same to BLS and the Indian Government just to let them know that you did receive them safely. Quote your file number or the Passport number with you.

Thanks for the help,yes my wife is in India and having her passport with her so wont be able to provide original passport of my wife.

Any idea what needs to be done in such scenarios?

WHAT IT SAYS.

Marital Status:

- Funeral Home Certificates arenot acceptable.
If un-married:
- Parents Records of Landing and Indian Passports.
If parents are not Landed Immigrants or have never applied for a Permanent Residence status in Canada:
- Provide a self-declaration.
If divorced:
- Divorce certificate duly attested, and in English.
If the applicant is a minor below the age of 18: Provide documents of both parents to include:
- Indian Passport(s),
- Record(s) of Landing, Canadian Passport(s),
- Citizenship Certificate(s)
- Surrender Certificate(s), required only if you acquired foreign citizenship, on or after June 01, 2010.
- Marriage Certificate of parents; only if spouse’s name is not mentioned in either of parent’s Indian passports.

What they are asking is HER INDIAN PASSPORT, the one she landed with when you first moved into Canada.
ALSO, the RECORD OF LANDING that was attached to it by them.

They are not asking for her CANADIAN Passport, so search for it, unless she is carrying it with her. You must have it some place.
