Thanks a lot.
I have approached the board and got a hearing date in July for eviction proceedings. Any tips to face the board? I'm going all by myself.

It will be well worth the money and the time saved when you hire a Para-Legal to do the preparation of the case and also represent you at the Landlord Tenant Board hearing.
The money you spend is tax deductible and if there is no income at the rentals, then from the salary that you make. Consultation is FREE.
I also want to see the cheat evicted from the Basement. So, call one or get a referral from the Law offices. (Yellow Pages)
They charge a nominal $200 to prepare and $75 per hour to represent you there. So, prepare to pay and ask about the fee before you engage one.

Hello,
I have been going thru this post and link and interesting to know about landlord issue. I am still looking on clarity that if we have fixed terms lease agreement, can we ask tenant to proper notice to leave at expiration on lease using lease expiration clause? Or he will one side right to stay and extended the lease month to month against our wish?

When you own a home, you are the Lord and Master of the Castle. Now you know. ( Leave the dunce cap off-the crown I mean.)
But it is nice to give the proper, required notice in the form N 11 and have the cheque ready when you exchange the keys to the place with the last months rent. It will be nice to do that in writing. Links at the bottom.
AND Before you do that, preferably a day before, request the tenant for an entry into that place to INSPECT the place and assess the condition and any damage to that place. Also check the same over before he leaves once more to see that NO DAMAGES were done by the movers. It could happen in some cases.

About Ending a Tenancy
Renewing a lease
The end of a lease does not mean a tenant has to move out. A new lease can be made or the landlord and tenant can agree to renew the lease for another fixed term period.
If a new agreement is not reached, the tenant still has the right to stay:
as a monthly tenant, if they paid their rent by the month in the expired lease, or
as a weekly tenant, if they paid their rent by the week in the expired lease.
Where the tenant stays on as a monthly or weekly tenant, all the rules of the former lease will still apply to the landlord and tenant. But the landlord can increase the rent each year by the amount allowed under the Act.

Asha its good to know that you have approached the board and have a hearing in July. Keep us posted how things go.
Its weeks of wait and pain before you get your 5 minutes of hearing at the Board. As Full House recommended and I second, please do avail services of a Para Legal.

Hello everyone,
I had my hearing today and tenant handed over the keys to me. I did not have paralegal.
However, last 3 months have been very hard in the sense that I had been tested to the highest level of tolerance. My tenants called cops to my home (last thing I wanted), they had city knocking at my door (left a notice) and my kids are trying to put a brave front consoling me that it is going to be all right. My tenants did whatever they could to bring damage to my family. But result is that we are stronger than ever.
My unit is left in a very dirty condition. It will take a while to clean and get repairs done.
