I too know a little
There was this photograph in early 80s of the militant leaders from 4 different groups, that of Sri Sabaratnam from TELO, Padmanabha of EPRLF, Balakumar of EROS and Prabhakaran of LTTE standing shoulder to shoulder. The Tamils were proud that they would fight and win a homeland shortly. Just to ensure his suzerainty, the other three were mercilessly assassinated (even though they too were Tamils) by the person whose ID is known to everyone. If the other 3 had also been accommodated, it would have been a different story for the Tamils in Lanka.

The "hero" in discussion didn't want to fight elections, wanted to be crowned as the emperor of the Tamil part of Lanka, that too by Rajiv Gandhi's India. For refusing to do so, Rajiv Gandhi too was killed. In fact, anyone that terrorist organization would enter into "discussion" or "talks", more often to lull them into lowering their guard, would die (example Amrithalingam another tamil).
This was the organization, the accused were part of and in their payroll, according to the learned judges.

The story about Tamil Tiger is well known, it was more of a hitmen mafia than rebels. There used to be (and perhpaps is) a very widespread feeling among the locals in TN that the struggle to get Ealam is meaningless (even dangerous to the security of TN) but the oppressed citizens to fight it in democratic way.

No dispute to bring the LTTE to justice on Rajiv's killing but the lawyers have clearly raised their point that these three were not part of the conspiracy and they had no clue what was happening and were not part of the organization also.

The backdoor agenda of current political leaders fighting for the three is well known, their vested interest is open.

Why would the accused deserve such a sentence if they were not fully proven of committing such a crime.

The death sentence is given in only in the rarest of the rare cases and that too from special court to High Court and then to Supreme Court and then finally to Rashtrapathi Bhavan. Even the President does not take decision on her own accord but again consults a team of learned legal experts. The culprit really knows what he has done and stalls the proceedings by many months and years at each stage. There are lawyers here who help him in this delay. But beyond all this when the final judgement is delivered, it is asked, "Why did the system delay for all these years and explain day by day blow up".
In Rajiv Gandhi's assassination, the SIT was clueless at the beginning. The dead photographer had earlier been warned by his masters not to go too near Rajiv Gandhi and take photographs. Even though many were killed and strewn to pieces the camera remained intact. The assassin Sivarasan had been instructed to retrieve the camera after the incident. In the melee and in the hurry to get away, he thought the camera would not have survived. But it did miraculously, and I strongly believe it was by divine intervention, Sriperumpudur being a pilgrim centre and birth place of Sri Ramanuja founder of Visishta Advaita and Vaishnavism. For his act of omission, Sivarasan was never pardoned by the mafia, and the rescue squad never came to take him back even though he evaded arrest for many weeks. May be it was this divine intervention, which sounded the death knell for the organization.
In the photographs, it was a blow by blow account upto Rajiv Gandhi's blowing up, almost a live video shoot. Not only that, when the bye-standers antecedents were researched by SIT from their photographs, it was the public who gave their knowabouts, like that they were their tenants from such and such a period etc. When that was further followed up, their links with one another slowly emerged and finally the entire chain and anchor.
From the famous Hari Babu photographs one really cannot forget that face of the lady who had been pardoned, awaiting excitedly to watch the event, like the final over of a T20 match.
As far as India is concerned, the fight to abolish death sentence is only a ruse for not upholding or following law, be it jumping the red signal or killing people in cold blood. This has got nothing to do with mercy or human rights

Can anyone explain me?
This is a word by word translation from the tamil weekly Thuglak

Crime committed by Rajiv Gandhis Assassins
By S. Pushpavanam
Thuglak Magazine dated 05 10 2011
That mercy should be shown to the assassins of Rajiv Gandhi who have been sentenced to death, is going on as a campaign with the help of television channels. For this, those who have been known as Tamil Feelers have now taken avatar as Humanism Protectors. In this situation, would like to share with readers some facts regarding this assassination.
Lawyer S. Natarajan (who argued for Prabhakaran in the Jaffna Mayor murder case), Sri Sabarathnam, Amrithalingam, Yogeswaran, George, Vasudevan, Padmanabha, Kriban, Yoga Sankari and four others and further Ranjan Wijayaratne, Premadasa, Lakshman Kadirgamar, Kamini Dissanayake, Neelam Tiruselvan, Arunachalam Thangadurai, Sam Thambimuthu, Sarojini Yogeswaran and many others were murdered by LTTE. Morover, leaders of LTTE themselves like Mathaiah and Kittu had also been killed. What is common between all these people?
That they were not liked by Prabhakaran, they were all condemned as traitors. Without any mercy or humanism they were done to death in a cowardly manner. In all the above killings done on unarmed people, except for Ranjan, Kamini and Premadasa all others were Tamils and are only a few from the list of Tamils killed by LTTE.
From many Tamil families, boys were kidnapped, used as shields against the bullets of Lankan army and were made victims. When Prabhakaran was killed, these Tamil families celebrated happily. This only is the story of LTTE who assassinated Rajiv Gandhi.
For those who assassinated Rajiv Gandhi, the accused were interrogated by the court properly. The Indian government provided them as many as ten lawyers. Fees paid to them by the Indian government themselves. Twenty six of them were accused on two hundred and fifty one counts.
Even before the charge sheet could be filed, the accused had given as many as 112 petitions. Before the verdict was given all of these had been gone through. The Prosecution began its case on May 5, 1993. The proceedings began on January 19, 1994. More than 1000 documents and witnesses were taken up by the court. The Special Court gave its verdict on January 28, 1998.
When the case came to the Supreme Court, the court heard arguments from both sides and on May 5, 1999, confirmed the death sentence on Perarivalan, Murugan, Santhan and Nalini. Later, the sentence on Nalini was commuted to Life sentence. For the others (22 nos.), the period spent in prison itself was considered as punishment and were released. The Governor of Tamil Nadu, took up the mercy petitions and reduced the sentence on Nalini to that of life. The mercy petitions of the remaining three were rejected by him.
But the Humanism Protectors, who did not open their mouth about Prabhakarans countless killings, even forgetfully, telling that the death sentence handed out after such a systematic trial, as an inhuman act, is both fun and pain.
Some going to the peak of false propaganda, state that all the 3 were innocent and ask, Should there death sentence for just buying and giving a battery?
Some dailies also give space for this propaganda. The roles played by the so called innocents in the assassination of Rajiv Gandhi are reminded to the readers in the notes given below.
Arivu alias Perarivalan
Son of a famous LTTE leader. Spread shop in public places to sell audio/video cassettes, brochures and books and provide funds for LTTE. Clandestinely went to Sri Lanka along with Tiger leader Baby Subramaniam and stayed there between May and November 1990. His video photos with LTTE are available with Special Investigation Team. Knowing fully well assassinating Rajiv Gandhi himself was the plan, Perarivalan in full breath helped the LTTE Sivarasan.
Buying a Bajaj motorcycle in his name and giving it to Sivarasan, buying battery for the wireless set and buying Golden Power battery for triggering the bomb tied to Dhanu were his acts. After the assassination was over, Pearivalan did the work of news communication. From LTTE hideouts, recorded Doordarshan news telecast and sending them to Jaffna was his main job. Frequently went to Subha Sundaram studio, exchanged information and participated in making plans. Murugan on and off would stay in his house.
Murugan
He belonged to LTTE spy wing. To carry out Rajiv assassination under Sivarasan, 9 members landed at Kodiakarai. Murugan was one among them. Wireless communication, helping Sivarasan in several ways and money distribution were his main responsibilities. Murugan, as he fell in love with Nalini, was ordered back to Jaffna by Pottu Amman. When he was waiting at Kodiakarai for his return, Sivarasan found that Nalinis co operation was getting reduced and hence called Murugan back.
Before going back to Jaffna, Murugan had given to Kodiakarai Shanmugam important letters, weapons, books and expense accounts for safekeeping. Shanmugam had buried the same on the beaches. When Shanmugam was arrested, all these were dug out and had provided strong evidence for the Special Investigation Team. Murugans role was fully exposed.
Indhu Master alias Murugan was only responsible for brainwashing Nalini into believing that Rajiv was deserved to be killed and for that they can do whatever was required. To this extent he had brought Nalini.
On May 7, 1991, a dry run was conducted at V.P. Singh meeting, in which Perarivalan, photographer Haribabu, Nalini and Sivarasan participated.
From Murugans Madipakkam house, wireless sets, code language sheets were captured. When he was caught, Murugan tried to consume cyanide. He was stopped and arrested.
Santhan
Chinna Santhan alias Sudhendira Raja was Sivarasans assistant. He also belonged to LTTEs spy wing. Along with Sivarasan, on May 2nd, he came to Chennai and stayed at Jayakumar house. He also stayed with Haribabu also for a week.
Chinna Santhan came to Kodiakarai on May 1st, under Sivarasan leadership. He brought tigers like Siva Rooban from Vedaranyam to Trichy. To carry information to Sivarasans colleagues, money distribution, arranging for meetings, take terrorists from one hide out to the next etc., were his main jobs.
Chinna Santhan was caught by the IPKF in Jaffna in 1988 and was jailed. In Feb 1990, with the help of Sivarasans monetary help, joined Chennai M.I.E.T. college. His role was crucial in Padmanabas assassination. In Zackaria colony, he moved with EPRLF and won their faith. He monitored Padmanabas movements, informed Sivarasan about the same and arranged for the mass killing of Padmanaba and seven others.
On April 28, 1991, when Chinna Santhan met Pottu Amman along with Sivarasan, the assassination plot of Rajiv Gandhi was explained to him. He was the first person to know from Sivarasan, that Sriperumpudur was the chosen place for this killing. The arrangements made after this belonged to him. Through Maragadam Chandrasekars (Congress leader) son he donated Rs. 5 lacs to get permission to garland Rajiv Gandhi. After Rajiv Gandhi assassination, he sat next to the auto rickshaw driver and travelled to Chennai, Sivarasan, Suba and Nalini being the other passengers. He provided the contact between Sivarasan and Trichy Santhan to help Sivarasans escape.
All the above were the Poorvothram of the assassins and this was proved in the Supreme Court. They were all sentenced to death only for the important roles they played in the Rajiv Gandhis and others killings.
It is being argued that Rajiv Gandhi himself would have forgiven his assassins. But in 1984, when his mother Indira Gandhi was assassinated and death sentence was given to Satwant Singh he did not prevent the same from being carried out.
What about those killed along with Rajiv Gandhi? The television channels which show a victim familys sorrow , even for one death, do not debate the injustice done to the families of 17 killed along with Rajiv Gandhi. This terrorist act was done knowing fully well that many innocent bye-standers too would be killed.
Those killed with Rajiv Gandhi were
1. P.K. Gupta, Rajiv Gandhis Security Officer.
2. P.K.S. Mohammed Iqbal, Supdt. Of Police, Chengelpet.
3. Rajaguru, Inspector, Pallavaram Police Station.
4. C. Edward Joseph, CB-CID Inspector.
5. V. Ethirajulu, Sub-Inspector, Kundrathur Police Station.
6. S. Murugan, Police Constable, Somangalam Police Station.
7. R. Ravichandran, Commando Constable, SP CID.
8. Dharman, Kanchipuram Special Branch Constable.
9. Thirumathi Chandra, Kanchipuram Constable.
10. Thirumathi Latha Kannan, Arakonam.
11. Selvi Kokila Vani, daughter of Latha Kannan.
12. Thirumathi Shantanu Begum, Thirumullaivayil.
13. Dariel Peter, of the assassins gang.
14. Selvi Saroja Devi, Sriperumpudur.
15. Munusamy, (Former MLC, Chennai).
16. Dhanu (Human Bomb)
17. Hari Babu, photographer.
Apart from members of the plot, will the victims forgive the assassins, assuming they return to earth as ghosts or real life people? Or will their families ever forgive the assassins.
With highly appreciated special investigation, the trial went on for 6 years; opportunities were provided for both sides, the Special Court pronounced its verdict. The Supreme Court confirmed the death sentence on the three. After this, their mercy petitions to the Governor were rejected for valid reasons. Another mercy petition to the President was rejected for valid reasons. After all this, saying death sentence should not be given as time has lapsed and there is no room for the same under the Rules would not be acceptable to anyone with self conscience.
==========================================
One small request. Will ex-patriates stop supporting or funding the letter pad parties in Tamil Nadu. They will only do more harm to their cause.

After the takeover of the Chief Justice post by mr. Sathasivam from Tamil Nadu, there seems to be a new line of thinking on death sentence and especially on Rajiv Gandhi's killers.

The Supreme Court had recently passed a judgment, that because of the mental agony caused to the Rajiv Gandhi's assassins for waiting too long in the death row, the SC has commuted their sentence to one of life. Since they have spent more than 20 years in person already, the SC had also said the government can consider ordering their release.

The judgment was received with great jubiliation by leaders of fringe political parties. In an year of elections Karunanidhi and Jayalalitha also said they welcomed the judgement. Jayalalitha called for a cabinet meeting and ordered for the release of all seven convicts within 3 days pending any objection by the Central Government.

Only then those who want the country to be one at both the state and centre woke up from the slumber and now the central government has filed for a review of the SC judgment. SC has also realised that it might have opened pandora's box inviting release of all given death sentence and criticism of how the convicts earlier were hanged (like that of Afzal Guru and Kasab).

After their petitions have been rejected any number of times by the HC and SC and having reached the doors of the President, it may be for the President to dispose off, whether it takes 20 days, 20 years or 200 years. How can SC again interfere after they have themselves upheld the death sentence is the question many ask.
