Dear CD's,

Can someone recommend a good lawyer who specializes in "wrongful dismissal" cases? Someone who doesn’t charge any upfront fees!! I need this ASAP.
Also, feedbacks from people who have taken their employer to the court for wrongful dismissal & harassment would be appreciated.

:(

My sincere advise to you is "Move on" .
If you will fall in trap with the lawyers/suckers you will only waste your nerve ,time , money and efforts . In most of the battles ( including injuries ) ONLY lawyers / physicians are the winners .
Before you pursue any legal step make sure that all your incidents are very well documented and had been brought into the notice of seniors . If you can prove that no action was taken than only you can sue .
I know it is very hurtful to be dismissed and I pray that you get your next assignment shortly which will help you to forget the incident .
Other CD's may have a different opinion .
Good Luck

I second Ashwani.
Unless you are a female and have been working for atleast 10 years in a MNC (payroll more then 1 million a month), you stand no chance.
No lawyer will come forward to represent you unless you are a female and pay upfront. It is easier to get a lawyer for free , if you are a male and you have been involved in a car accident. Not in wrongful dismissal case.
You can however file a claim with the labour ministry (current processing time is 14 months) and they can help you with a settlement as dictated by the labour ministry terms and conditions.
Remember that Canada is a country which favour employers more than the employees. If the employer dismissed you as per govt. regulations, you stand no chance.
Complaining to the human rights tribunal will work if you are a visible minority and you have the proof to back you up. This is a free service thrown at immigrants and an effective one at that.
Peace

Appreciated, AshwaniG.

Its very true that we employees (read common people) do not have the financial clout to take on these huge organizations, in this case its a bank governed by the Federal law.
I know I have done nothing wrong, but because I couldnt suck up to the Manager, I have been put on the chopping block.
I am just waiting for the EI to kick in, hopefully it should. Is there any legal aid available in ON for appeals and other processes if EI is refused, because the Manager is hell bent on seeing that I dont get EI !!!!

I always thought that a 1st world country has more transparency in terms of implementation of legal justice, but maybe that's only a mis-conception. :(

I had never dealt with EI and hence not aware with all intricacies . Probably TK can shed more light on it . However I am under impression that your manager has no influence on EI approval as they have their own norms and procedures .
Good luck with your future endeavors.
