Speeding Ticket 10km/hr Over.

I got a speeding ticket with 10km/hr over for 40$. The officer tracked me with 72km/hr in a 50km/hr zone, but lowered it to 10km/hr.
The ticket mentions section 128.

Can someone advise:
1. Does this ticket include points?
2. should I pay this outright and shouldnt worry abut insurance?
3. Should I fight it?

10K above limit does not have any demerit point, if you pay the ticket it will appear in your driving record for three years for any insurance company or organization to see. So, basically fighting this ticket is your own call. In this case you can win only when Police Officer fail to show up on Court date otherwise you don't have chance to win.

Couple of things if I can get some advise.

1. If I decide to fight and the officer shows up, can this turn into a worse situation, knowing that he actually gave me a break by lowering my offence.
2. Will there be an impact on the insurance premium if I simply pay the ticket and that it will stay on my record for 3 years despite no demerit points
3. If the answer to #2 is yes then should I hire a lawyer

1-Normally it does not get worse. Whatever normally Judge do, the officer already did for you. So I don’t think it will get any better either.

2-This ticket may impact your insurance but that is solely depends on your insurance company and your past driving record. I had two minor convictions ( same like yours) and insurance company did not raise my premium but all companies are not that good.

3-Hiring Lawyer will be useless in your case as normally they can get your ticket reduced to what you already have but they cannot do anything beyond this.

So basically what I see that you don’t have many options. If I would be in your situation I would take this case to trial by myself (without hiring a lawyer) and if Officer does not show up case will be dismissed otherwise I will pay the fine.

fight it, get a court date.
reschedule the first court date and go to court hoping the cop wunt show up.

Whats the purpose of rescheduling the first court date? Is that in order to dodge the officer?

If it is 10Km over....most likely police officer will not come.

Where did you get the ticket. In Mississauga and Toronto...likely hood of police officer not showing up is greater. If it is Kitchner Waterloo...they the officer will come as he may not have anything else to do.
