I would fight for it if i can save my points
I would fight not to save 175$ for ticket BUT for 3 demerit points... in long run it helps , -

But again paying 500$ for just 3 points is to much , cant you just go and defend your self into court ?

Car insurance is already expensive and u dont want them to charge u more..

so make your own calculation.

You shouoold go to court and like has been said here, say the truth, apologize, cite that this is the first time this has happened and was due to poor weather conditions and hope for the best. If you are genuine, the judge will see this and give you credit for ur honesty.

Good luck and keep us posted.

I have done this before and it is from my personal experience ( at Edwards street court).

1-2 days before the court date, go and visit the various courts and sit down in the visitors section while the court is in session. Observe and listen what is being said and what the paralegals are actually doing. You will find many who represent themselves.

On the date and time of your trial, you will be called upon by the public prosecutor (PP) who will sitting on a table facing the judge, even when the judge is still not in court. Go and approach him/her, mark your presence and tell PP that you wish to plead guilty with explanation. The PP will offer you the decision (lower fault and no points) and you can request (haggle) a little bit. You can either take it or refuse it. If you take it - when the Judge enters, they will call out all those who wish to plead guilty with explanation first and whatever the PP offered will be converted to a decision. If you wish to state something in your defense you can say it at that time - but the decision will probably not change.

If you did not accept the PP's offer and decide to contest against the ticket, your name will be called towards the end and your decision to contest noted officially in front of the judge. Then you will be asked to wait till all others are finished and your case will come for hearing/arguments. It is not a good idea to defend yourself if you are not conversant with Legal jargon and not fully prepared - hire a lawyer instead (not paralegal - they cannot defend you for NOT GUILTY charge).

If you observe the proceedings a few days in advance, you will have time to prepare yourself on the date of your trial.

Once again, please refer to my earlier post - once you plead guilty - whatever flowery explanation you give to judge has NO bearing on the insurance - they will treat you as GUILTY and the premium is calculated according to infraction. If your policy as exemption for 1st at fault accident, it might not actually effect the premium on renewal - until your next at fault accident.

Good luck.

There are two things here, jumping a red light and an accident.

What are you doing about the accident? Have you made any settlement or is the other party going to claim it from their insurance?
