I work for a financial institution in a customer service environment, and a part of my job involves up-selling and cross-selling financial products and services to customers who call in with their banking needs.
Since the last few months, I have not been able to meet the sales targets, and now the bank is planning to terminate my job. However, I consistently meet the other job responsibilities that I am entrusted with. Recently, my boss tried to give me a warning letter stating that I am falling behind on my targets, and if I do start performing in terms of sales, they will ultimately terminate my service. I exercised my legal rights, and refused to sign any document, and told him point blank that when I was recruited for this job 5 yrs back, I was recruited as service personnel, not a telephone salesman.

I am trying for other jobs, but since the job market is bad, I have not been able to find anything suitable yet.
The worse case scenario is that they will fire me; in that case, can I apply for EI? Am I eligible for EI if my ROI states that I was fired from my job due to performance issues related to sales?
Do the EI authorities check the bank balance/assets (I don’t have much savings here, except a little something in rrsp) before they decide on a candidate’s eligibility for EI?

Confused!!

Will appreciate some feedbacks. Never taken EI before in my life:(

I am on EI (fired but still got EI) and hence in a position to advise you.
EI does not depend on your savings. So donot worry.
If you canot meet your sales targets and they fire or lay you off, you still can get EI/ Termination pay / Severence. If you do a mistake in your job and they fire you, you still can get EI. If you donot know how to work and they fire you, you still can get EI
However, if the company is able to prove that you were not obeying orders to do the work assigned to you and you are given warning letters as a result of it(3 is the min. required for firing) and then if they fire you, you will not be able to get EI.
There is a fine line dividing these clause/ conditions and the companies really know how to fire you so that you will not get EI and thus they need not provide you with reference, termination / severence pay etc...
My advise to you is to be proactive and ..........(fill in the blanks yourself)

Peace by a PD

In reason for issuing ROE, if they put "shortage of work," you will get EI. If they fire you they will put reason as "Dismissal," in which case you can apply for EI but they will investigate whether or not to give you EI.

Well TK,as for the warning letters, I am exersicing my legal rights not to sign and accept, so they cant prove that I was given prior warning.
Since I have never applied for EI in my 7 yrs of being in this country, not sure whether I will qualify or not, incase I ultimately lose my job because of non-performnance!
People with experience in this can comment, I hope.

Today the market is bad and govt knows that....

As long as you meet minimum hours requirement ...changes are u will get EI, u just need to prove that they have been not fair to you, lot of mental stress, and pushing...... therefore u were losing concentration towards works, and that effects your performance...
i am assuming u were there on time and doing your duty regardless of performance review .... if they don’t have any other proof that u were going late everyday or spending lot of time talking to others or personal phone conversation then u don’t need to worry.

If it is a big company with a lot of prior experience in giving warning letters and firing people, then be rest assured that they will take into consideration the factors. Just because, you donot sign and accept a warning letter does not mean that you never got one. If I were in your postion (thinking in hindsight), I would surely take steps to find another job and move or make sure that you will get EI once you are out of the office. I am seeing that the economy is picking up and jobs are available as of now (if you have cdn. work experience). However preference will be for native population, failing which it will go to immigrants/citizens of VM origin.
You just need 910 hours of payroll salary in the past 52 weeks to get EI. You generally get it in 4-6 months of payroll (salary) work. So donot worry much about that.
Being on EI will entitle you to take some courses at the college , institute or university for up to max. 28,000 $ (Tution , living allowance etc...)
Hope this helps.
