Guys,
Thanks for the encouragement.
Would like to clarify some points :

1. Practick - Yes. the touble has been brewing for a couple of years. Some times, I get over the mood in a couple of days when he calls us in to meetings and gives dire indirect warnings. I as an highly educated profession would feel like I am treated like a slave.
Architecture is a subjective field. The work which I did in 18 hours, could be done in 8 hours or 48 hours and no one can fire based on that. B'cos, I have to search for some data in the by-law and I had documented (and left in the office), as to how I extraced data and used it in the drawing.

2. It was not a hasty decision or on the spot decision to fight with my employer. I always thought about it for the past 5 years and only yesterday executed it. The reason for the delay was that I was sufferring from the " Blind dog", "Stockholm Syndrome" syndromes in which my mind constantly told me that, If I quit, then my employer would not be able to find a replacement for me and thus suffer. In this recession time , there are a lot of fired Canadian educated guys to fill up my spot and as of today, I have contacted one guy and have asked him to apply at my office.

3. B'lorean : EI is not anyone's tax money. It is my right to get it , if the Govt determines that I was let go unfairly. . Just b'cos I am a brown skinned person, I do not want the employer to treat me like a second class citizen. Examples include : asking me to throw the garbage in the Dump truck, Asking me to help move the office supplies from the car to the store room etc.... and now this.
How can the employer ask me to submit my resignation at his table for telling him that he was treating me unfairly b'cos I was a visible miniority? Is this sentence not a violation of my carter of rights and freedom?

4. Architecture is a very funny field. No one asks for references in the last office that you worked.. Most firms are highly jealous of each other and all firms pay just aound the poverty level. Also all firms demand that you show them drawings of your previous works in the office worked before but then will tell you that all the drawings that you do in the interviewed office are the property of that office and no drawings can be removed from the office for your personal portfolio. Everyone knows in this industry that people steal these drawings.
I would not even care 2 cents for my previous company as anyway it was a very low level company. However, I do have some Canadian educated people's references.

5. I would be a fool if I was even thinking of searching for an Architectural job. Even when the going was good, I never used to receive even one enquiry. As said I will look towards SAP etc..

6. Again, it is futile to continue this dicussion until my ROE comes by end of next week when I will see if I was fired or let go and then I will get back for more ideas in this matter.

thanks for all your encouragement

Peace by TK

IBM, SUN and SAP may be among the hardest hit technology companies in 2009 as spending on computers, software and services drops for the first time in six years.

SAP recently said that it will cut 3,000 jobs as 2009 will “remain challenging” and offer “limited visibility.”

The German software giant said it expects the cuts to save 300 million to 350 million Euros of cost savings starting in 2010. With those cuts, the company expects to reduce its staff to 48,500 positions. SAP said it will not provide specific 2009 guidance due to the uncertainty in the economic and business environment.

In normal situation, it is difficult to find SAP job without any implementation experiance and certification. Under the current market, It will be even harder for any individual to do a SAP course and expect to be employed immediately, when experiance SAP consultants are on bench in IT companies as new projects are either dropped or postponed.

Do keep above in mind.

Good luck,

Agreed that these days new jobs are hard to come by

But we also have to go on & Not get bogged down ( i know it is easy to say)

For example.....if SAP or PeopleSoft jobs are tight now......will that mean there will be no new person ever willing to learn these in the future ?

If Software field is down, will there be no one joining BE Computers or MS Computers.

If housing sector is down, will ontario colleges stop the housing / trade certification courses forever ?

There are still scores of people joining these courses with a hope for a career.

I can say one thing, in North America, one should always try to upgrade and network........we never know when they come in handy.

I say most of the suggestions posted by CD's are honest & relevant.

Be optimistic and keep trying

TK,

Sorry to hear about the unfortunate incident.

Do you have your appointment order, the annual performance/increment papers along with information on your holidays, absence and other work related information.

DO NOT DESPAIR.

The following information is for you if you are sure you will not be called back or you will not go back to them if they call you back when the temper(s) subside.

You are lucky to be in Ontario. The province of Ontario is the most labour friendly in comparison to the other provinces. Most of the time nearly 90% + of the time the labour is supported and labour friendly and not management friendly. What you need to do is to call the ministry of labour immediately. You can also look up the nearest one to your home and walk in to schedule an appointment. You will be assigned a case officer. You should not communicate to your employers or sign any forms or papers with them. You should explain your case in detail along with exact dates, your continued service and also the notice severance pay as mentioned in your appointment order. Is there an internet usage clause in your appointment order?. Even if there is a clause how will somebody establish that you were on the internet for work related cause or personal reason. This typically does not hold up in Ontario. In regards to the internet usage did they give you a verbal warning followed by 3 written warnings. If not you win. They can NOT throw somebody out of work without establishing a case. :) I strongly suspect that you will get EI and the reason will be given as slow down of work.;) You should also find the name, current address and also the telephone number of the people who have been let go in similar manner to you earlier from your organization. You should provide the list to this case officer. The more precise paper trail you have with dates, times and location the more the stronger the case is. It might take about 6 to 8 months for the case to come up but you'll get justice. They need to pay you the severance pay and you should get the 50 Weeks EI at nearly CAD 413 per week. If any hitch on the EI, you have the right to file with EI and file with discrepancy.

There are professional lawyers who can fight your case and will take a percentage of your proceeds after winning the case.

We desis do not want to take up issues and we want to move away. Do take up this issue even if it is of no use to you, but it'll help others in your organization.
