Hi Tamilkuravan, I was in the same boat few months ago....working in the middle east like you... never thought of being laid off but things are quite different in this part of the world. Since our canadian company bought by Indian company last year. One fine day, director of my dept. , without giving called and informed that I am no more needed from today and reason given was down sizing in the company initially for me that was the end of the world....I was so hurt and in disbelief that how come it happens to me as I put all my heart and soul in work but thats the reality of this world...been without job for another 4 months and then one day my manager called and asked if I can join them back as some senior guys in our dept. left and they look desperately some experienced person...so I joined them back and within next one month I got offered from Govt. job which I applied during the time I was laidoff. So I resigned from my Company this time and joined Govt. job and much happy in current job. So moral of my story is I will never get my current job if I was not laid off. So think positively that whatever happened is for the good cause and I am sure you will get much better opportunity then before. My prayers and best wishes for you....Good Luck !!!!

My understanding is, even if ROE says "Terminated", that doesn't automatically take away your EI entitlement.... Until a misconduct or misbehavious is proven on your part, EI people can't say no to you.....
and Onus of proof is upon your employer ....
If not impossible, it is very difficult for an employer to prove misconduct or misbehaviour on employee's part.... and even if employer can prove, who's got time and energy to do that...unless he has some personal grudge against you and is determined to teach you a lesson....
So I don't think you even would need to hire a lawyer, as far as your EI is concerned..... yes you may have to make one or two extra trips to EI office..
I agree that you have a good shot at EI.
You already made the situation bad by abusing the system and arguing with your ex employer. By taking legal action, I think you are making it worse. Also, think about what you want to achieve by taking legal action:- more compensation or your job back which both may not be possible in your case.
I worked out the the below items when things were not going good for me and it did wonders for me and I am far more better off now both financially and career wise.
1. Say sorry to your boss and start looking for other jobs. Employers always want to know about your recent job and his(bad) reference will hurt you badly.
2. Don't ever abuse the system in future.
3. Get away from this gora/indian discriminating attitude. If you are good, every body appreciates you no matter what color you are.
Wish you all the best.
Hey TK,
man, if one door closes, another opens. Keep up the spirit.
There is a saying" Whatever happens , happens for the best".
There must be a similar saying in ur native tongue.
Never say die.
Persist. Keep a positive attitude.
Think Rambo, think Rocky.
Think Clint Eastwood.
Just go sock it to them.

TK Bhai,
First of all sorry for your loss.
However there is always a silver lining. Esp after a deluge there will be fish to catch and a fine harvest. Having said all that I have the following observations, some CD's may not agree:-
1. Agree with you - no point backing down.
2. Agree with you - people with worse have gotten away with much worse.
3. Need to move on
4. Make some noise by way of litigation - do not make it your full day activity.
5. Receission is there yes, however jobs are there for the right people.
6. We have come to Canada to earn money/ have a better quality of life. May be struggle / do a change in scene, go the the Gulf / else where - you have experience.
There are so many options. TK you would be better off asking this forum for networking info, contacts etc based on your work experience and I am sure no one will bat an eyelid in providing a reference or guiding you as you have guided many CD's.
We are here to help with info we have and are more than willing to share.
We have to stick togeather in these tough times.
Kind Regards and all the best to you.
RJ
TK,
- Just move ahead. Everybody is there to help you in whatever way possible.
- I find you a Hardworking, Honest & Wise man.
- You will surely overcome this situation.
-Best Regards & Best Luck
