Hi rajcanada

That is the first think i DID - Mistake

i asked them to put me on list if there is layoff, since then everythihg change at my company towards me.

manager/team lead / they used to be friendly and now they just talk about work and that it.. u can feel the difference.

Anyways, i just got the news that because i asked them layoff , they decided not to give me layoff and they want me quite- so they dont have to pay package to me.

also , i think i hurt their feelings by asking layoff

anyways, damaged DONE, but i m still trying to have good relationship so they might change their mind and give me layoff or allteast they dont remove my name if its on list.

Hrdc process is complicated they don’t give me YES or NO answer , they want me to apply for EI benefits once file is open they can take decision before that they don’t say yes or no.




If your wife has a year of maternity leave in which she can stay home and take care of your baby, why dont you spend that year attempting to apply for and find a job in Toronto so you can move to a new job??

I agree reason #17 is for employment related reasons only. EI is an insurance against job loss that is outside of your control or due to your spouse having to relocate for a job.

Reason #22 - reasonable assurance to me means a letter from an employer indicating they are willing to hire you if you move. Not "the job market is good in my occupation". In this economy I dont know how convincing that argument would be. YOu may know your occupation better?

I agree. It is the same case in my previous office, where once you ask for layoff, then they start treating you differently and finally coherce you to quit or find ways to fire you

Well ! may not be the case you mentioned. Sometime, they want to lay off team X and if you are from Team Y and ask for layoff, they will not give you since you were not in the original list of people to be laid off.

May be not their feelings but they might have felt that you have made up your mind to be laid off / quit. Since they donot want / have the power to lay you off, they just act indifferently so that you get the que and quit/ resign

Yup. That is the best that you can do and hope and pray that the recession will affect your job and that the compay will be forced to lay you off.
the best position to ask for layoff is when the company forces all of you into the meeting room and tells you that 50% of the number gathered must be laid off and asks for volunteers. And if the volunteers donot add up to 50% of people to be laid off , then they will make their own list ( Eg. GM, Crysler etc...)

1) You already had a job in Quebec despite the "barrier" of french. HRSDC will argue that there is insufficient evidence unless say you were laid off and then spent a certain period of time looking for a job without success AND employers indicate this is due to lack of french language skills.

2) Asking for a way or "Trick" to get EI benefits .. means you know that you dont actually deserve or have the right to get them,so you are looking for a way. Is that ethical??

3) You cannot attend school while receiving EI benefits UNLESS you are approved to do so before you start school. There are different criteria for this, including lack of transferable skills.

If you know that you may be in a lay off situation, Why not start trying to improve your skills (take introductory french courses for example)? Find out what employers hire without french requirements or what industries you can enter without french.

I think as long as a person is actively job searching while collecting EI benefits, they are eligible to receive their benefits. I dont think it would matter where they are in Canada.

I agree, that wasnt the wisest move. You told them that basically you are not a team player and that you *dont* want to be with the company. Your loyalty and commitment to your team/work is no longer there (by your statement/request). Asking for a lay off isnt usually a good idea.

In today's economy and with jobs being as scarce as they are, I think its important not to jepardize a permanent/solid employment situation. If your wife who is on maternity anyway, wants to move to Toronto to find a job while she's on leave, why doesnt she go to find a job? As you said, there are relatives available out there to help her.
