EI Clarification

Hi,

I am working for an organization which is soon be restructuring. So they are planning to lay us off.

I have a couple of questions:

1) If they give us a package in lieu of notice plus my leave days, is it true that I will not get any EI for the first month?

Does the size of the package determine which month you can start applying for EI?

2) Do I then get EI for the next 6 months? So in my case if they lay me off in 1st Dec 2008, do I start claiming EI from 1st Jan 2009 until 30th June 2009

3) In was planning to go to India … should I file immediately after been laid off in Dec or should I file after coming back.

I was planning to go to india for around 1 month so be back around first week of Jan 2009.

Yes. The size of termination package that you received determines the starting time of your EI. Plus there is always two week of grace period before you can start receiving your EI

I do not know the recent rules, but I believe that the duration of your EI depends upon the time you have been with the company, upto a maximum of one year. Also the amount of EI you receive depends upon your pay upto a maximum of per month

Check it first, but it does not matter whether you file now or later. The EI is going to start the day it is suppose to start. If you file it later, you may get it retroactively . Tell them that you are out of Ontario for specified period of time

Also,all these applications are done online. So you can do it while you are in India too

That depends on the area that you are living in. In toronto,

the Minimum Number of Weeks Payable for Regular Benefits is 15 weeks.

So in your case, less than 4 months.

You MAY be able to enroll on a course which can prolong the EI benefits. Whether you should enroll in the beginning or near the end - I am not sure. Hope somebody else can guide you on this.


3) I dug this from http://www.hrsdc.gc.ca/eng/ei/faq/faq_general.shtml

"Delaying in filing your claim for benefits beyond than 4 weeks after your last day of work may cause loss of benefits. "


Now, your question whether you can receive EI for 14 weeks after coming back from India is a good one.

Does the 14 weeks start the day you were laid off, or do they start after say, you coming back from India after for example spending 6 weeks in India.

I don't know. Maybe other Canadiandesi members maybe able to give their input on this.

4) Additional Info

When should I expect my first payment?

If we have all the required information and if you qualify for benefits, your payment will be issued usually within 28 days from the date we receive your application. If you do not qualify, we will notify you of the decision made on your claim.

Sorry for the outdated info I had given in my previous post.

I just gave some information base on my layoff in 2004. Things have changed after that

Hi,

My gross pay is just over $4000 per month - which they have to pay me in lieu of notice.

Plus my vacation dues - around 20 working days.

I think that brings the total to around $7000.

Does anybody know how that affects the maximum payment of $435 (of EI) per week?

if you receive EI, you are allowed max. of 2 weeks (officially) in which you can do other things (incl. travel outside of Canada-the frozen land) apart from looking for work which is the purpose of EI.
Though the EI dept. does not keep track of what you do in the days that you are on EI (apart from calling you one day to the centre and informing you the options in EI), it is your duty to inform the EI official when you will be availing the 2 weeks allowed to travel outside the country.

It is best to go to a service Canada office to find out about all this. Some of the people are very helpful there.
I just helped a lady who got laid off whose biweekly (every two weeks)pay was around $1800.
Her original contract said if she was laid off she would get 2 weeks pay for every year worked there as compensation plus a bonus decided at the time of being surplussed(fired).
She worked for 4 years - so her package was 8 weeks pay plus a small bonus.
We went to the service Canada off in Brampton and there the receptionist gave her a booklet to read thru and told her that she was eligible for EI only after 8 weeks were over, but she should open her file now and when she received her record of employment (ROE) she should drop it off at the office .
Because she was laid off, she told the receptionist she wanted to leave Canada and come back after a month. The receptionist said it was cool but she should do it after she opened the file and dropped off her ROE. With the file open, then things are more speedily dealt with at the time when compensation begins
She also said that EI was upto 55% of salary and upto 45 weeks from day compensation starts

In another case a lady was laid off after 17 years in the company. Her package was 34 weeks of salary. In her case, the EI receptionist told her it would be ver diificult to get any EI as they expect that one should get a job within 13-16 weeks of getting laid off.

So best to go to a service Canada off to enquire.

Also check your original job offer letter. Don't assume you'll get only a month's pay. It might be more or less and is usually based on weeks per year worked not month per year worked as salaries are usually paid bi-weekly here. (Some companies pay weekly also). Also open your file immdtly upon lay-off and send in your ROE when you receive it. There are comps available at the service canada offices or alternatively you can do it from home.
