Interesting indeed and terrible, considering the disruption to your life.

Unfortunately, nothing is surprising in the article. US border takes a dim view of, criminal convictions (regardless of waivers); lack of meeting (most up to date) requirements for TN; and perception of border shopping. In other words, you give them the most feeble excuse, they'll take it and barr you entry.

I believe, if one is sure that everything is in order and nothing is wrong from one's side, then, all such incidents should be reported to news media not only in Canada but also in U.S.A. Apart from that, if law permits; concerned border agents should be sued individually. Because if more and more people bring this kind of incidents to media and legal systems than only one can expect that respective government would consider alternative citizen friendly procedures.

I believe, if one is sure that everything is in order and nothing is wrong from one's side, then, all such incidents should be reported to news media not only in Canada but also in U.S.A. Apart from that, if law permits; concerned border agents should be sued individually. Because if more and more people bring this kind of incidents to media and legal systems than only one can expect that respective government would consider alternative citizen friendly procedures.

...and the burden of proof is on you, not on the immigration officers, whether it be at POE or at a consulate. So, yes, it may feel to be out of control, but unless the candidate can prove it at the POE or in a court, nothing much will change.

Reforms are usually pursued by AILA (American Immigration Lawyers Association) at the legislative and judicial levels of the Govt. But then, unless it is something bordering that of the recent priority date fiasco, where AILA sued and USCIS modified the terms, very little tangible results are seen. Again, the relenting of the USCIS on that issue may or may not have been due to the lawsuit (USCIS might have realized, for once, their stupidity).
