Can you explain it a bit more? Your statement is quite confusing.
A real estate agent (as i perceive) is a medium negotiates the price for his interested party and arranges for the party to visit the houses etc.. As far as i know, in the situation that you have described, the realtor himself/ herself will have no clue about the situation that you are talking about. It may be a lawyer who can find out if the title is proper or not. In anycase, the buyer of the house will visit a lawyer himself.
There are specific tasks which can be preformed by a specific type of people (eg. lawyer, inspector etc..). For the problem that you have described, a hemself/ herself could not have found it out.
There was a post before hand in which a CD claimed that he was cheated by a realtor. In this case, can we conclude that all buying and selling has to be done without a realtor?

I think Title Search, Title Insurance (Whatever it is called) could have saved them as it goes through if the land is clear or not.
