I was also fired citing ‘M’ in my ROE. This is the same employer who has brought the case against me in small claims court. First he removed me from job few days short of probation period and issued instructions to bank to stop payment for the cheque already given to me for my last week salary. I had to take help of Ministry of Labor. MOL got that last week salary plus overtime from him to me. The same employer appealed against my EI saying that my work was not satisfactory. He personally appeared before the panel but lost. He re-appealed and lost again. HRSDC even termed my removal from the job as ‘Wrongful Dismissal’. I got the EI. But all these developments made him badly angry. Next, this employer sued me in Small Claims Court for damage to company (rented) vehicle without mentioning that he was employer. I am in China on my present job and have spent $$$ to defend myself. Case is in progress.

they fired 5 people form the same company in one week period...they all are going to try for EI and see wat happenes..hes got his severants(dont know how it spells) pays as well..he applied today...but i know it iwll take em few more weeks to give him answer..and i have feeling the answer will be no..i really want a know shud appeal now or after he gets the answer...if he does wat shud he say? shud he say that he wud like to knwo y they fired him? and he wud like to know cuz so in future he dont make the same mistake?
and about ur car rental problem..i wrk for a car rental company..i wud like to know..when the accident happen..was ur boss with u?
did he say u tookk the car without his knowledge?

"Hmm. Termination without just cause. I suppose he was in probation-Jahnavi."
Does that means, during probation period one can be removed even with unjust cause. I was removed few days short of my probation period. The HRSDC has documented my removal from job as ‘Wrongful Dismissal’, during hearing of my EI case. So can I pursue case of wrongful dismissal against my employer, even if he removed me few days before the completion of probation period? However it is hard to prove that company car accident was the real reason for my removal. The only proof I got is HRSDC paper terming this as Wrongful Dismissal.
